Private Law Child Proceedings

We have four specialists in this area of work.The firm is regularly instructed in respect of private law children applications under the Children Act 1989. The firm frequently acts for parents and extended family members in disputes over residence, shared residence, contact, parental responsibility, removal from the jurisdiction and special guardianship orders. The firm also deals with matters in relation to specific orders to a child namely disputes between parents over where the child should attend school, etc.

If in the course of such proceedings it is necessary to instruct experts, Sinclairslaw will ensure that an appropriately qualified expert will be instructed in order to ensure that your interests are best met.

When considering any application to the Court, The Primary Consideration will be the welfare of the child/children.The following considerations are then paramount;

1.The ascertainable wishes and feelings of the children

2.Their physical, emotional and educational needs

3.Likely effect of any change of circumstance.

4.The age, sex, background and any characteristics of the child, which the court considers relevant

5.Any harm a child has suffered or is at risk of suffering

6. How capable each of the parents or any other person in relation to whom the Court considers a question to be relevant is in meeting the child's needs.

7. The range of powers available to the Court in the proceedings in question.
