Court of Protection

Sinclairslaw has a specialist team experienced in all matters relating to the Court of Protection.

The Court of Protection is the arena in which disputes about individuals who lack capacity are resolved. That person is referred to as the protected party.

Our dedicated team are able to assist with matters such as:

• Deputyship applications for Property & Financial Affairs and Personal Welfare;
• Issues regarding Deprivation of Liberty;
• Disputes concerning where a person should live;
• Disputes concerning medical treatment including those relating to life-sustaining treatment and end of life decisions;
• Disputes concerning contact including sexual relations;

We can react immediately to provide urgent legal assistance where disputes arise in emergency situations such as disagreements at hospital about whether medical treatment should be administered or withdrawn.

The team is regularly instructed on behalf of the protected party through Independent Mental Capacity Advocates, Relevant Persons Representatives and the protected party’s family or friends. Our experienced team are instructed by the Official Solicitor on the protected party’s behalf on a regular basis.

Our Court of Protection experts are based in both Cardiff and London meaning that Sinclairslaw can offer a nationwide service in this area of law. We act for clients throughout England and Wales.

We can assist in cases where disputes arise. You or the person concerned may be entitled to Legal Help and/or Legal Aid, depending on financial means and the merits of the case, to bring the matter before the Court of Protection.
