
Pre-marital Agreement
Often people decide to cohabit and not to marry. However, in the event of separation the same financial issues often arise and need to be addressed and resolved. Pre-marital agreements are designed to avoid ambiguity upon separation and avoid the costly process of Court proceedings. Couples can then:-
- Have a formal Declaration of Trust drafted specifying how a property is owned;
- Enter into a written agreement signed by both parties setting out the basis upon which any assets are to be divided.
It is important to note that if parties subsequently marry these agreements are not currently enforceable in England and Wales.
