First Meeting

This initial meeting is designed to:
  • Enable us to identify any relevant legal issues
  • Explore options available to achieve the best possible outcome to successfully resolve matters
  • Deal with any queries
  • Agree a suitable course of action
  • Tailor advice to the particular circumstances of your case
  • To provide you with details of the likely costs of the agreed course of action and of the options available to fund your case
  • Written confirmation of advice given
What it doesn’t include
  • Any correspondence required to implement agreed course of action
  • Any further work arising from the meeting
  • Completion of any documents

Negotiating an Agreement

  • Discussions centred around the current and proposed arrangements for the children
  • Advising as to the merits of these proposals
  • Identifying any issues arising
  • Corresponding with your spouse/partner setting out detailed proposals
  • Dealing with response received together with any counter proposals
  • Monitoring progress of any agreement reached
  • Advice re: other options to include referral to mediation if appropriate

Preparing application to issue proceedings

In circumstances when agreement cannot be reached and all other options have been explored, an application to the Court for a Child Arrangement Order is necessary to resolve matters. This next steps involves:

  • Completion of an application form for a Child Arrangement Order
  • Filing with the Court to issue proceedings
  • Effecting postal service of application and Notice of Hearing upon the Respondent i.e. your former spouse/partner. (N.B Please note that this does not include personal service. Where this proves necessary, additional process service fees will be payable)
  • Filing Statement of Service with the Court
  • Advising in relation to Court process and next steps to be taken

Representing you at the First Court Appointment

  • Thirty minutes attendance upon you at Court prior to the First Appointment hearing
  • Representing you at the hearing
  • If an agreement is reached, drafting a Consent Order and filing with the Court
  • If no agreement is reached, identifying relevant issues and obtaining a Directions Order from the Court tailored to the individual circumstances of your case.

Going forward

At this stage, a further fixed fee package will be designed to take account of the individual circumstances of your case with reference to the extent and complexity of the issues which will determine the level of work to be conducted and associated costs.
