Drafting consent documentation incoporating provisions of agreement reached

It is important that any agreement reached addressing the financial aspects of the divorce is incorporated into a Court Consent Order. This ensures that the agreement can be enforced with the assistance of the Court and ensures that all loose ends are tied up to avoid any potential financial repercussions in the future. It is vital that the agreement is accurately recorded in a format accepted by the Court and ratified by a District Judge.

This next step includes:
  • Initial meeting obtaining instructions in relation to the agreement reached. This service is suitable in cases that are not unusually complex and where there are no issues arising regarding financial disclosure, i.e. where financial disclosure has been provided within the mediation process
  • Corresponding with your spouse/partner setting out in detail the terms of the proposed Agreement
  • Drafting the Consent Order incorporating the provisions of the agreement reached
  • Drafting the Consent Application
  • Drafting the Statement of Information form setting out your financial circumstances
  • Filing with the Court
What it doesn’t include:
  • Advice as to the merits of the agreement
  • Seeking financial disclosure
  • Negotiating a financial settlement
  • The Court fee of £50 payable to the Court to file the consent order
