Record number of pupils in England receiving SEN support

Recent headlines, including on the BBC website (Record 1 in 5 pupils in England getting special education needs support - BBC News), have put a spotlight on issues surrounding education for those with special educational needs (“SEN”). England has seen a massive 44% in the number of pupils requiring support since 2016, which when combined with recent statistics showing the highest number of Tribunal cases on record, highlights just how much work needs to be done to ensure the system provides effective provision and support those with SEN. This increased demand raises many concerns, especially, as many will worry that this might directly impact children and young people perhaps unable to receive appropriate support or will be missed all together.

Concern surrounding government plans to reform SEN in the Autumn, and the rise in those who are now being recognised as SEN (the number of those with an ECHP in place has nearly doubled since 2016), raises many questions about funding such as what support is available to those who are struggling with the various legal complications that can arise. It also underpins why it is vital that legal advice is sought to navigate the complex legislation surrounding SEN and education law broadly.

The increase in those recognised as having SEN and obtaining ECHPs in England, is particularly alarming in Wales, which is governed by the relatively new Additional Learning Needs Act (2018) rather than the SEN system which evidences an overall reduction in those with Individual Development Plans (IDP’s) (Wales’s equivalent to an ECHP) compared to before the act being implemented. This further shows the disparity between England and Wales education systems.
